Fond du Loc, Wisconsin Building Codes

Overview

Fond du Loc adopted the Wisconsin state residential and commercial codes with amendments.  "The following chapters of the Wisconsin Administrative Code are hereby adopted and incorporated into this article by reference:

  • SPS 320 Administration and Enforcement
  • SPS 321 Construction Standards
  • SPS 322 Energy Conservation
  • SPS 323 Heating, Ventilation and Air Conditioning
  • SPS 324 Electrical Standards
  • SPS 325 Plumbing
  • SPS 361 to 365   Commercial Building Code
  • SPS 366 Existing Buildings
  • SPS 375 to 379   Buildings Constructed Prior to 1914

Althought the state residential building code only applies to new construction, additions and alterations for buildings constructed after 1980, Fond du Loc extends the requirements to all alterations and repairs.  "Every alteration or repair to any part of any existing building shall be made to conform to the requirements of this article for new buildings, except if technically infeasible." Id.  Maintenance must also be done as set forth in the amendments.  Id.

Note that for commecial purposes, Wisconsin adopted the 2009 IBC.  It applies to "code applies to all public buildings and places of employment" with certain exception.  See Wis. Admin. Code § 361.02. The Code defines "public buildings" and "places of employment." Id.

The highest authority is reserved by the state. See Wis. Admin. Code § 361.03. However, local jurisdictions may adopt stricter standard that are not in conflict. Id.  Furthermore, local jurisdiction, including counties, may take on inspection and review responsibilities.  See Wis. Admin. Code § 361.60

Wisconsin adopted the 2009 IEBC, subject to the modifications specified in chapter SPS 366.

"When an existing building or structure is damaged by fire or other cause or if alterations and repairs are made to an extent of 50% or more of the assessed value of such building or structure before such damage or alteration divided by the ratio of the assessed value to the recommended value as last published by the State Supervisor of Assessments for the municipality within which building or structure is located, the entire building or structure shall be made to comply with the requirements of this article for new buildings or be demolished."  Fond du Loc Building Code, § 255-9 (accessed 6/30/2014).

Existing buildings, meaning buildings that were built in accordance to code at the time of construction, typically merit extra consideration in a current updated code.
